Probate is expensive and time consuming. Probate is something that if you can avoid it, you want to do that. You probably understand and probably have heard of the context of someone passing away, that is when probate typically comes into effect. What you want to do is work with an attorney who will put together and estate plan for you where you can avoid probate. You want to make certain that without going to court, all of your assets are distributed by a will, a trust, or through a deed.
Now all those can be handled, the best way to do it is through a trust. A trust is an agreement with yourself and that document will allow you, in most cases if set up correctly, to completely avoid probate, completely avoid the expense of it and the time wasted between when you pass and when the assets that you have are ultimately distributed to your loved ones.
